ইসলামী উত্তরাধিকার ব্যবস্থার অন্যতম গুরুত্বপূর্ণ বৈশিষ্ট্য হলো, কোনো ব্যক্তি মারা যাওয়ার পর তার রেখে যাওয়া সম্পত্তি কারা কতটুকু পাবেন, সে বিষয়ে শরিয়ত নির্দিষ্ট বিধান দিয়েছে। কোরআনের সূরা নিসার ১১ ও ১২ নম্বর আয়াতে উত্তরাধিকার সংক্রান্ত গুরুত্বপূর্ণ নির্দেশনা রয়েছে।

কিন্তু একজন ব্যক্তি জীবিত থাকা অবস্থায় তার নিজের মালিকানাধীন সম্পত্তির ক্ষেত্রে পরিস্থিতি ভিন্ন। তিনি চাইলে জীবদ্দশায় কাউকে হেবা বা দান করতে পারেন। তবে সেই দানের উদ্দেশ্য, পদ্ধতি এবং এর ফলে অন্যদের অধিকার ক্ষুণ্ন হচ্ছে কি না, তা গুরুত্বপূর্ণ বিবেচ্য।

শায়খ আহমাদুল্লাহর প্রকাশিত বক্তব্য অনুযায়ী, কোনো বাবা-মায়ের অন্য কোনো সন্তান না থাকলে জীবদ্দশায় একমাত্র মেয়েকে সম্পদ দান করার বিষয়ে আলেমদের মধ্যে মতামতের আলোচনা রয়েছে এবং অধিকতর বিশুদ্ধ মত হিসেবে এটিকে বৈধ বলা হয়েছে। তবে অন্য ওয়ারিশদের বঞ্চিত করার উদ্দেশ্যে এমন পদক্ষেপ নেওয়া উচিত নয়।

ভাতিজারা কি সবসময় ওয়ারিশ?

এখানে একটি সূক্ষ্ম বিষয় রয়েছে।

কেউ যদি বলেন, “আমি আমার মেয়েকে সব সম্পত্তি দিলে আমার ভাতিজারা বঞ্চিত হবে”—তাহলে প্রথমেই দেখতে হবে ওই ভাতিজারা আদৌ সেই ব্যক্তির মৃত্যুর পর বৈধ উত্তরাধিকারী হবেন কি না।

ইসলামী উত্তরাধিকার আইনে নিকটবর্তী ওয়ারিশের উপস্থিতি অনেক সময় দূরবর্তী আত্মীয়ের উত্তরাধিকার পাওয়ার বিষয়টি পরিবর্তন করে। যেমন, মৃত ব্যক্তির সন্তান, পিতা, ভাই বা অন্যান্য নির্দিষ্ট ওয়ারিশ জীবিত থাকলে কোনো কোনো ক্ষেত্রে ভাতিজা উত্তরাধিকার থেকে বাদ পড়তে পারেন।

অর্থাৎ শুধু আত্মীয়তার সম্পর্ক থাকলেই কেউ স্বয়ংক্রিয়ভাবে সম্পত্তির ওয়ারিশ হয়ে যান না। উত্তরাধিকার নির্ধারণের সময় মৃত ব্যক্তির জীবিত ওয়ারিশদের পূর্ণ তালিকা, আত্মীয়তার সম্পর্ক এবং প্রযোজ্য শরিয়তি বিধান বিবেচনা করতে হয়।

মৃত্যুর পর মেয়েকে সব সম্পত্তি দেওয়ার ওসিয়ত

বিষয়টি যদি জীবদ্দশার দান না হয়ে মৃত্যুর পর কার্যকর হওয়ার জন্য ওসিয়ত হয়, তাহলে বিধান আলাদা।

শায়খ আহমাদুল্লাহর ব্যাখ্যায়, কোনো ব্যক্তি যদি বলে যান, “আমার মৃত্যুর পর আমার সব সম্পত্তি আমার মেয়ের হবে,” তাহলে অন্যান্য ওয়ারিশের অনুমোদনের প্রশ্ন আসে। প্রকাশিত ব্যাখ্যায় বলা হয়েছে, অন্যান্য ওয়ারিশরা সম্মতি দিলে এমন ওসিয়ত কার্যকর হওয়ার সুযোগ রয়েছে; একই সঙ্গে অনেক আলেম “কোনো ওয়ারিশের জন্য ওসিয়ত নেই” মর্মে হাদিসের ভিত্তিতে এ ধরনের ওসিয়তকে অনুমোদন করেন না, যদি না অন্যান্য ওয়ারিশ সম্মতি দেন।

এখানে তাই ওসিয়ত এবং হেবা শব্দ দুটির পার্থক্য অত্যন্ত গুরুত্বপূর্ণ।

জীবিত অবস্থায় কার্যকর হেবা এক বিষয়। মৃত্যুর পর কার্যকর করার ঘোষণা আরেক বিষয়।

অন্য ওয়ারিশকে বঞ্চিত করার উদ্দেশ্য কেন গুরুত্বপূর্ণ?

সম্পত্তি নিয়ে পারিবারিক আবেগ অনেক সময় সিদ্ধান্তকে প্রভাবিত করে। কেউ হয়তো মনে করেন, একটি নির্দিষ্ট সন্তান বাবা-মায়ের বেশি যত্ন নেয়। কেউ আবার ভাবেন, মেয়েকে সম্পত্তি দিলে ভবিষ্যতে সে নিরাপদ থাকবে। এমন ব্যক্তিগত কারণ থাকতে পারে।

কিন্তু ইসলামি দৃষ্টিতে উদ্দেশ্য একটি গুরুত্বপূর্ণ নৈতিক উপাদান।

শায়খ আহমাদুল্লাহর বক্তব্যে বিশেষভাবে বলা হয়েছে, অন্য ওয়ারিশদের বঞ্চিত করার উদ্দেশ্যে মেয়েকে সব সম্পত্তি লিখে দেওয়া উচিত নয়। অর্থাৎ সম্পত্তি হস্তান্তরের বাহ্যিক রূপের পাশাপাশি এর পেছনের অভিপ্রায়ও বিবেচ্য।

এটি উত্তরাধিকার আইনের একটি মৌলিক নৈতিক দিককে সামনে আনে। সম্পত্তি শুধু অর্থনৈতিক সম্পদ নয়; অনেক ক্ষেত্রে এটি পরিবারের একাধিক সদস্যের অধিকার, নিরাপত্তা এবং ভবিষ্যৎ জীবনের সঙ্গে যুক্ত।

মেয়ের উত্তরাধিকার অধিকারও নিশ্চিত করতে হবে

এ আলোচনার আরেকটি গুরুত্বপূর্ণ দিক হলো, মেয়েকে সম্পত্তি থেকে বঞ্চিত করার সামাজিক প্রবণতা কোনোভাবেই ইসলামসম্মত নয়।

শায়খ আহমাদুল্লাহ তাঁর একটি লেখায় উল্লেখ করেছেন, উত্তরাধিকার বণ্টনে নারীরা ঐতিহাসিকভাবে বঞ্চনার শিকার হয়েছেন। তিনি বিশেষ করে এমন সামাজিক মানসিকতার সমালোচনা করেছেন যেখানে মেয়েকে সম্পত্তি দিলে তা “অন্য বাড়িতে চলে যাবে” বলে মনে করা হয়।

অতএব, “ভাতিজাদের বঞ্চিত করা যাবে কি না” প্রশ্নের পাশাপাশি “মেয়ের বৈধ অধিকার কী” সেটিও সমান গুরুত্বপূর্ণ।

ইসলামী উত্তরাধিকার ব্যবস্থায় কোনো নারী কেবল নারী হওয়ার কারণে তার বৈধ অংশ থেকে বঞ্চিত হতে পারেন না।

সম্পত্তি লিখে দেওয়া মানেই মালিকানা বদলে যাওয়া নয়

বাস্তব জীবনে অনেক সময় বলা হয়, “বাবা তো মেয়ের নামে সম্পত্তি লিখে দিয়েছেন।” কিন্তু আইনি ও শরিয়তি দৃষ্টিকোণ থেকে এই কথাটির অর্থ সবসময় এক নয়।

কোনো দলিলে নাম লিখে দেওয়া, হেবা সম্পন্ন করা, দখল হস্তান্তর করা, অথবা মৃত্যুর পর সম্পত্তি দেওয়ার ইচ্ছা প্রকাশ করা—প্রতিটির আইনি ও ধর্মীয় তাৎপর্য আলাদা হতে পারে।

তাই কোনো নির্দিষ্ট সম্পত্তি নিয়ে সিদ্ধান্ত নেওয়ার আগে দলিলের প্রকৃতি, মালিকানা, দখল, জীবিত ওয়ারিশ এবং স্থানীয় আইন বিবেচনা করা প্রয়োজন।

ভাতিজাদের বিষয়টি কেন জটিল?

ভাতিজা উত্তরাধিকারী হবেন কি না, সেটি নির্ভর করে পারিবারিক উত্তরাধিকার কাঠামোর ওপর। এ কারণে “ভাতিজাদের বঞ্চিত করে মেয়েকে সব দেওয়া” কথাটি শুনেই সরাসরি জায়েজ বা নাজায়েজের সিদ্ধান্ত দেওয়া ঠিক নয়।

প্রথমে জানতে হবে: মালিক জীবিত, নাকি মৃত?

সম্পত্তিটি হেবা, বিক্রি, নাকি ওসিয়তের মাধ্যমে হস্তান্তরের কথা বলা হচ্ছে?

মৃত্যুর সময় কারা কারা জীবিত ছিলেন?

মৃত ব্যক্তির সন্তান, বাবা-মা, স্বামী বা স্ত্রী, ভাই-বোন কিংবা অন্য সম্ভাব্য ওয়ারিশ কারা ছিলেন?

এসব তথ্য ছাড়া নির্দিষ্ট উত্তরাধিকার হিসাব করা সম্ভব নয়।

ইসলামী বিধানের মূল শিক্ষা

সম্পত্তি নিয়ে ইসলামের নির্দেশনার কেন্দ্রে রয়েছে ন্যায়, অধিকার এবং দায়িত্ববোধ।

কেউ যেন নিজের বৈধ সম্পত্তি নিয়ে সিদ্ধান্ত নেওয়ার ক্ষেত্রে অন্যের হক নষ্ট না করেন। আবার কোনো মেয়ের বৈধ উত্তরাধিকারও যেন সামাজিক কুসংস্কার বা পারিবারিক চাপের কারণে হারিয়ে না যায়।

শায়খ আহমাদুল্লাহর বক্তব্যের সারকথাও এই ভারসাম্যের দিকেই ইঙ্গিত করে: জীবিত অবস্থায় দান এবং মৃত্যুর পর উত্তরাধিকার এক বিষয় নয়; আর অন্য ওয়ারিশকে বঞ্চিত করার উদ্দেশ্য থাকলে বিষয়টি নৈতিকভাবে গুরুতর হয়ে ওঠে।

শেষ কথা

ভাতিজাদের বঞ্চিত করে মেয়েকে সব সম্পত্তি লিখে দেওয়া প্রশ্নটির উত্তর পারিবারিক পরিস্থিতি ও সম্পত্তি হস্তান্তরের ধরন না জেনে এক কথায় দেওয়া যায় না।

যদি জীবিত অবস্থায় বৈধ হেবা করা হয়, সেটির বিধান এক রকম। আর মৃত্যুর পর কার্যকর করার জন্য ওসিয়ত করা হলে বিধান ভিন্ন। একইভাবে, কোনো ভাতিজা আদৌ উত্তরাধিকারী কি না, সেটিও আলাদা করে নির্ধারণ করতে হয়।

সবচেয়ে গুরুত্বপূর্ণ বিষয় হলো, ইসলামের উত্তরাধিকার বিধানকে পাশ কাটিয়ে কাউকে ইচ্ছাকৃতভাবে তার বৈধ অধিকার থেকে বঞ্চিত করা উচিত নয়। একই সঙ্গে মেয়েদের ন্যায্য অধিকার নিশ্চিত করাও ইসলামী ন্যায়নীতির গুরুত্বপূর্ণ অংশ।

কোনো বাস্তব সম্পত্তি বণ্টনের ক্ষেত্রে তাই পারিবারিক তথ্য ও দলিল দেখে যোগ্য আলেম এবং প্রয়োজনে স্থানীয় আইনজীবীর পরামর্শ নেওয়াই সবচেয়ে নিরাপদ পথ।

উত্তরাধিকার আর জীবদ্দশার দান এক নয়

মৃত্যুর পর মেয়েকে সব সম্পত্তি দেওয়ার ওসিয়ত

বিষয়টি যদি জীবদ্দশার দান না হয়ে মৃত্যুর পর কার্যকর হওয়ার জন্য ওসিয়ত হয়, তাহলে বিধান আলাদা।

শায়খ আহমাদুল্লাহর ব্যাখ্যায়, কোনো ব্যক্তি যদি বলে যান, “আমার মৃত্যুর পর আমার সব সম্পত্তি আমার মেয়ের হবে,” তাহলে অন্যান্য ওয়ারিশের অনুমোদনের প্রশ্ন আসে। প্রকাশিত ব্যাখ্যায় বলা হয়েছে, অন্যান্য ওয়ারিশরা সম্মতি দিলে এমন ওসিয়ত কার্যকর হওয়ার সুযোগ রয়েছে; একই সঙ্গে অনেক আলেম “কোনো ওয়ারিশের জন্য ওসিয়ত নেই” মর্মে হাদিসের ভিত্তিতে এ ধরনের ওসিয়তকে অনুমোদন করেন না, যদি না অন্যান্য ওয়ারিশ সম্মতি দেন।

এখানে তাই ওসিয়ত এবং হেবা শব্দ দুটির পার্থক্য অত্যন্ত গুরুত্বপূর্ণ।

অন্য ওয়ারিশকে বঞ্চিত করার উদ্দেশ্য কেন গুরুত্বপূর্ণ?

সম্পত্তি নিয়ে পারিবারিক আবেগ অনেক সময় সিদ্ধান্তকে প্রভাবিত করে। কেউ হয়তো মনে করেন, একটি নির্দিষ্ট সন্তান বাবা-মায়ের বেশি যত্ন নেয়। কেউ আবার ভাবেন, মেয়েকে সম্পত্তি দিলে ভবিষ্যতে সে নিরাপদ থাকবে। এমন ব্যক্তিগত কারণ থাকতে পারে।

কিন্তু ইসলামি দৃষ্টিতে উদ্দেশ্য একটি গুরুত্বপূর্ণ নৈতিক উপাদান।

মেয়ের উত্তরাধিকার অধিকারও নিশ্চিত করতে হবে

এ আলোচনার আরেকটি গুরুত্বপূর্ণ দিক হলো, মেয়েকে সম্পত্তি থেকে বঞ্চিত করার সামাজিক প্রবণতা কোনোভাবেই ইসলামসম্মত নয়।
